Lausanne, 28 August 2013 – The Court of
Arbitration for Sport (CAS) has today dismissed the appeals filed by Fenerbahce
SK and FC Metalist Kharkiv against the decisions taken by UEFA to exclude them
from the European club competitions. Due to the urgency of both matters, the
CAS Panels have issued their decision without the grounds. The full, reasoned
awards will be issued as soon as possible.
Fenerbahce SK v. UEFA
UEFA excluded Fenerbahce SK of the UEFA
club competitions for two seasons because of match-fixing. The Turkish club
appealed such decision to the CAS and in agreement with the parties the CAS
established an expedited procedural timetable and granted a stay of the UEFA
decision to the Turkish club, allowing it to take part in the qualification
phase of the current edition of the Champions League until the outcome of the
CAS appeal was known. A two-day
hearing was held at the CAS headquarters on
21 and 22 August 2013.
Pursuant to
the UEFA decision, which is now
confirmed by the CAS, Fenerbahce
SK is
excluded from two editions of the UEFA club
competitions.
FC Metalist Kharkiv v. UEFA
Following a decision taken by a CAS Panel
on 2 August 2013 in relation to an appeal against a decision of the Ukrainian
Football Federation, UEFA excluded FC Metalist Kharkiv from the UEFA club
competitions, edition 2013/2014, due to match-fixing. The Ukrainian club then appealed
to the CAS to request that the UEFA decision be suspended pending the outcome
of the CAS proceedings. This request for provisional measures was dismissed on
16 August 2013. A second request for provisional measures was then filed by the
Ukrainian club on the same day and was rejected on 20 August 2013. The parties
agreed to an expedited procedure, and a hearing was held at the CAS on Tuesday,
27 August 2013.
Pursuant to the UEFA decision, which is now
confirmed by the CAS, FC Metalist Kharkiv is excluded from the UEFA club
competitions 2013/14.
